These Terms of Service (“Terms”) govern your access to and use of www.formzend.com, purchases of FormZend plans, account access, downloads, and use of the FormZend WordPress plugin (together, the “Services”).

By accessing the website, creating an account, purchasing a license, or installing/using FormZend, you agree to these Terms. If you do not agree, do not use the Services.

1. Who we are

The Services are operated by:

In these Terms, “FormZend,” “we,” “us,” and “our” refer to the operator above. “You” means the individual or organization using the Services.

2. What FormZend is

FormZend is a WordPress plugin that helps you design reusable email templates for supported form plugins and WordPress system emails. FormZend:

  • is not a form builder;
  • is not an SMTP, ESP, or transactional email delivery service;
  • does not replace your form plugin’s notification rules or recipient settings; and
  • renders templates through your WordPress site’s normal mail process.

Email deliverability depends on your hosting, DNS, mail provider, reputation, and content—not on FormZend alone.

3. Eligibility and accounts

You must be able to form a binding contract to use the Services. If you use FormZend on behalf of an organization, you represent that you have authority to bind that organization.

You are responsible for:

  • keeping account credentials confidential;
  • all activity under your account; and
  • providing accurate billing and contact information.

Notify us promptly if you suspect unauthorized access to your account or license key.

4. Plans, licenses, and site limits

FormZend is sold as a licensed software product. Plans (such as Starter, Professional, and Agency) primarily differ by how many sites you may license. Unless we state otherwise, every paid plan includes the full FormZend designer and stable integrations available at the time of purchase.

Your license:

  • is limited, non-exclusive, and non-transferable (except as allowed in writing);
  • permits use on the number of WordPress sites included in your plan;
  • is for your own sites or sites you manage for clients, subject to the site limit; and
  • does not grant ownership of FormZend source code, branding, or related IP.

You may not share, resell, sublicense, or publicly redistribute the plugin package or license keys except as expressly allowed by your plan or a separate written agreement.

5. License activation, renewals, and expiry

After purchase you receive access to downloads and a license key. Activating a license against a site may transmit the site URL and license status to our licensing systems so we can validate entitlements and provide updates.

If a license expires or is not renewed:

  • existing templates may continue to render on already-connected sites; and
  • plugin software updates and new activations may pause until the license is active again.

We may change plan names, pricing, site limits, or included features for future purchases. Changes will not retroactively remove core purchased entitlements during an already-paid active license term, except as required by law or for security/abuse reasons.

6. Orders, payment, and taxes

Orders are processed through our website checkout. Prices are shown at checkout and may exclude applicable taxes unless stated otherwise. You authorize us and our payment processors to charge the payment method you provide.

You are responsible for any taxes, duties, or similar charges associated with your purchase, except taxes based on our income.

We may refuse or cancel an order if we suspect fraud, pricing error, payment failure, or Terms violations.

7. Refunds

We offer a 7-day refund on first-time FormZend purchases if the product is not working as described and we cannot resolve the issue after reasonable support. Refund requests should be emailed to hello@formzend.com. Renewals, upgrades, and purchases obtained through unauthorized resellers are generally non-refundable unless required by law.”

If a refund is issued, your license may be deactivated and download/update access may end.

8. Acceptable use

You agree not to:

  • use FormZend for unlawful, deceptive, or abusive purposes;
  • attempt to bypass licensing, site limits, or update controls;
  • reverse engineer, decompile, or create derivative products from FormZend except to the extent permitted by applicable law;
  • remove proprietary notices from the software;
  • interfere with the website, licensing systems, or other customers; or
  • use the Services in a way that violates others’ rights or applicable anti-spam / privacy laws.

You are solely responsible for the content of emails your site sends and for complying with laws that apply to your forms, mailing practices, and personal data processing.

9. Your content and your sites

You retain ownership of templates, copy, media, and other content you create with FormZend on your WordPress sites (“Your Content”).

You grant us only the limited rights needed to operate the Services—for example, processing license activations, providing support you request, and improving the product based on anonymized/aggregate usage where applicable.

FormZend does not claim ownership of form submissions or emails processed on your WordPress sites. Those remain between you, your site visitors, and your own service providers.

10. Third-party products

FormZend may integrate with third-party WordPress plugins, themes, hosts, and mail providers. We do not control those products and are not responsible for their availability, changes, bugs, or policies. Your use of third-party products is governed by their terms.

11. Support

Support is provided according to your plan and our then-current support practices. Priority support (where offered) does not guarantee response times or resolution of every issue, especially issues caused by third-party plugins, custom code, hosting, or mail infrastructure.

12. Intellectual property

FormZend, the website, documentation, logos, and related materials are owned by us or our licensors and protected by intellectual property laws. Except for the limited license granted under these Terms, no rights are transferred to you.

You may not use FormZend branding in a way that suggests sponsorship or endorsement without our prior written permission.

13. Beta / experimental features

We may offer preview or experimental features. Those features are provided as-is, may change or be withdrawn, and may be less reliable than generally available features.

14. Disclaimer of warranties

To the maximum extent permitted by law, the Services are provided “as is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that FormZend will be uninterrupted, error-free, or compatible with every WordPress setup, plugin combination, or mail provider, or that emails will be delivered, opened, or rendered identically across all clients.

15. Limitation of liability

To the maximum extent permitted by law, FormZend and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities, arising out of or related to the Services or these Terms.

Our total aggregate liability for any claim relating to the Services or these Terms will not exceed the amounts you paid to us for FormZend in the [12] months before the event giving rise to the claim.

Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the fullest extent permitted by law.

16. Indemnity

You will defend and indemnify FormZend against claims, damages, losses, and expenses (including reasonable legal fees) arising from Your Content, your websites, your emails/form practices, your misuse of the Services, or your violation of these Terms or applicable law.

17. Suspension and termination

We may suspend or terminate access to the website, downloads, licensing, or support if you materially breach these Terms, fail to pay amounts owed, or create security/legal risk.

You may stop using FormZend at any time. Provisions that by nature should survive (including IP, payment obligations, disclaimers, limitations of liability, and indemnity) will survive termination.

18. Privacy

Our collection and use of personal information is described in our Privacy Policy. By using the Services, you acknowledge that policy.

19. Changes to the Services or Terms

We may update the website, plugin, and these Terms from time to time. When we update these Terms, we will revise the “Last updated” date and may provide additional notice where appropriate. Continued use after changes become effective constitutes acceptance of the updated Terms.

20. Governing law

These Terms are governed by the laws of Australia, without regard to conflict-of-law rules. Courts located in Melbourne, Victoria will have exclusive jurisdiction over disputes, except where applicable law gives you mandatory rights to bring claims elsewhere.

21. General

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a reorganization, merger, or sale of assets. These Terms, together with any order/checkout terms and the Privacy Policy, are the entire agreement between you and us regarding the Services.
